Agreement Let’s take care of the legal stuff PAYMENT: The session payment is due upon scheduling the session. Once the payment is made, photographer shall reserve the time and date and will not make other reservations that will conflict with the session. For this reason all payments are NON-REFUNDABLE. RESCHEDULING/LATE ARRIVALS: In the event that the client requests to reschedule the session, the payment shall be applied to a rescheduled session date if one is available, and if notice is given at least 30 days prior to the rescheduled session. Rescheduled session must be within the same calendar year. Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session. MODEL RELEASE: Client grants permission to Kerri Rueda Photography and its assigns, licensees, and sublicensees, permission to use Client’s image or likeness in any and all forms of media for commercial purposes, advertising, trade, personal use, or any and all other uses. Kerri Rueda Photography may sell images containing Client’s likeness to third parties. The Photographer shall own the copyright of all images created. INDEMNIFICATION: The Photographer shall be held harmless for any and all injury to client during the course of the photography session or event, and the immediately surrounding events. EDITING: Client understands and agrees that original photographs are not included, only edits. Photographer retains the right to edit the photographs and omit any image. It is understood that Photographer will not deliver every exposure taken. Client understands and agrees to abide by Photographer’s editing decisions. Client understands and agrees that Photographer may perform digital retouching of images, including blemish removal, creative effects, teeth whitening, and other digital image edits. Client agrees to hold Photographer harmless for any edits which may be viewed as defamatory or demeaning. COMPLETION OF FINAL PRODUCT: Photographer agrees to provide no fewer than 8 digital images to Client delivered via online gallery within 2 weeks of the session. The client understands and agrees that photos delivered to Client are licensed for Client’s personal use only and shall not be submitted to contests or reproduced for commercial use.
